LATEST NEWS: After Off-White’s filing of trademark application “PRODUCT BAG” (quotations included) in May 2019 for use on “tops as clothing; bottoms as clothing”, the USPTO examining attorney refused the registration primarily on the basis that the mark “does not function as a trademark”.
Off-White’s counsel continues to fight for the registration of the “PRODUCT BAG” mark through amending it’s application from a 1(a) to 1(b) basis (from being in use in commerce to having a “bona fide intention” to use), filing a request for reconsideration of the refusal to register, and filing an appeal to the USPTO’s Trademark Trial and Appeal Board. ⠀
