LATEST NEWS: On August 17, 2020, the Canadian Internet Registration Authority released a decision regarding David Yurman IP LLC’s complaint of another party’s use of DAVIDYURMAN.CA.

According to paragraph 3.3 of the Domain Name Dispute Resolution Policy and Rules, a domain name is confusingly similar to a trademark when it “so nearly resembles the Mark in appearance, sound or the ideas suggested by the Mark as to be likely to be mistaken for the Mark”. The Single Member Panel found that the Domain Name was confusingly similar to the trademarks listed, the Registrant had no legitimate interest in the Domain Name, and the Domain Name was registered in bad faith.
